1. Agreement to Terms

Welcome to Recours Global HR. These Terms of Service ("Terms") constitute a legally binding agreement between you and Recours Global HR regarding your access to and use of our platform, website, and recruitment services. By creating an account, browsing our listings, or using any of our services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2. Description of Services

Recours Global HR provides modern talent acquisition, recruitment management, job distribution, candidate sourcing, and related human resources solutions. We connect job candidates seeking career opportunities with employers and recruitment professionals seeking qualified talent.

3. Candidate Responsibilities

Candidates using the platform agree to provide true, current, and complete information regarding their identity, contact details, work history, educational credentials, and qualifications. You are solely responsible for maintaining the accuracy of your profile and resumes. Misrepresentation, impersonation, or submitting fraudulent credentials may result in immediate suspension or termination of your account.

4. Employer Responsibilities

Employers and hiring organizations agree to use the platform solely for bona fide recruitment and hiring purposes. You agree to comply with all applicable labor, employment, non-discrimination, and data privacy regulations. Data extracted or accessed via our candidate search and applicant pipelines may not be harvested, resold, redistributed, or used for commercial marketing outside of authorized hiring activities.

5. AI-Assisted Features & Human Decision-Making

Our platform incorporates automated algorithms and artificial intelligence tools designed to assist users, including summarizing profile information, matching candidate qualifications with open job requirements, and recommending relevant interview topics. These tools serve as evaluative aids. All final decisions regarding candidate shortlisting, interview invitations, employment offers, and hiring remain solely under the judgment and responsibility of human recruiters and hiring managers.

6. Acceptable Use Policy

You agree not to engage in any prohibited activities, including:

• Posting false, misleading, discriminatory, or unlawful job listings or profiles.
• Attempting to probe, scan, or compromise the security or vulnerability of the platform.
• Using automated scrapers, bots, spiders, or extraction tools without our express written consent.
• Distributing viruses, malware, or unsolicited commercial communications (spam).
• Sharing account access credentials or permitting unauthorized third parties to operate your account.

7. Payments, Subscriptions & Billing

Certain employer services and premium features require paid subscriptions or transaction fees. All payments are billed in advance in accordance with the pricing terms presented at checkout. We partner with authorized payment processors, including Paystack and PesaPal, to securely process payments. Subscription fees are recurring unless cancelled prior to the renewal date. Fees are non-refundable for partial billing cycles or unused portions of services, except where required by law.

8. Intellectual Property Rights

The Recours Global platform, including its software, interface designs, text, graphics, logos, and proprietary features, are the exclusive property of Recours Global HR and are protected by applicable copyright, trademark, and intellectual property laws. Users retain ownership of their uploaded resumes, cover letters, and original materials, granting Recours Global a limited license to host, display, and process such materials solely to deliver recruitment services.

9. Account Closure & Data Removal

Users may request to close or delete their account at any time through their account settings or by contacting customer support. Upon receiving a closure request, accounts enter a 30-day recovery window during which they may be reactivated upon request. After 30 days, personal data and account records are permanently deleted, except where retention is required by statutory legal, financial, tax, or regulatory compliance standards.

10. Disclaimer of Warranties

The platform and all related services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. While we strive to maintain high service availability and accurate listings, Recours Global HR makes no guarantees that candidate applications will result in job offers, nor that employer job postings will yield successful hires.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Recours Global HR and its officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, employment opportunities, or business interruption, arising out of or in connection with your use of the platform.

12. Governing Law & Jurisdiction

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles. The courts of Nairobi, Kenya shall have exclusive jurisdiction over any legal proceedings relating to these Terms.

13. Dispute Resolution

In the event of any controversy, claim, or dispute arising between the parties, you agree to first attempt to resolve the matter informally by contacting our legal team. If the dispute cannot be settled amicably within thirty (30) days, it shall be referred to arbitration in Nairobi under the rules of the Kenyan Arbitration Act.

14. Modifications to Terms

We may update or modify these Terms from time to time to reflect changes in our services, regulatory obligations, or business practices. When material updates are made, we will provide notice through the platform or via email. Your continued use of the platform after revised Terms become effective constitutes your acceptance of the changes.
